Please read these Terms of Service ("Terms") carefully before using the Potolo Restaurant Platform. By accessing or using POTOLO Restaurant services, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
These Terms govern the relationship between you ("User") and POTOLO ("Company," "we," "us," or "our") in connection with restaurant-related services provided through the platform.
1. Introduction and Scope of Services
The Potolo Restaurant Platform enables Users to discover restaurants, browse menus, place food orders, schedule deliveries or pickups, make reservations, and interact with restaurant partners. POTOLO operates solely as a technology platform and intermediary. Restaurants listed on the platform are independent third parties responsible for food preparation, quality, hygiene, pricing, and fulfillment.
POTOLO does not prepare, cook, package, or deliver food unless explicitly stated otherwise.
2. Acceptance and Modification of Terms
By accessing or using the platform, you confirm that you have read, understood, and accepted these Terms. POTOLO reserves the right to modify these Terms at any time. Updated versions will be posted on the platform, and continued use constitutes acceptance of the revised Terms.
3. Eligibility and Account Responsibility
You must be at least eighteen (18) years old or the age of majority in your jurisdiction to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. Any unauthorized use must be reported to POTOLO immediately.
POTOLO is not liable for losses arising from unauthorized access caused by your failure to secure your account.
4. Prohibited Uses
You agree not to use the platform for unlawful purposes, including but not limited to fraudulent activity, impersonation, harassment, abuse, unauthorized access, data scraping, interference with platform operations, or transmission of harmful content.
Violation of these Terms may result in immediate suspension or termination of your account.
5. Restaurant Orders and Fulfillment
When placing an order, you are responsible for ensuring accuracy of menu selections, delivery address, contact details, and payment method. Prices, taxes, service charges, and delivery fees are displayed at checkout.
Once an order is accepted by a restaurant partner, cancellations or modifications are subject to that restaurant's policies and may not be possible. Delivery times are estimates only and may vary due to traffic, weather, demand, or operational constraints.
POTOLO is not responsible for food quality, portion sizes, allergens, preparation methods, or restaurant compliance with health regulations.
6. Payments and Cash on Delivery
POTOLO supports multiple payment methods, including digital payments and cash on delivery where available. Users selecting cash on delivery must ensure availability at delivery time and provide exact payment when required.
Failure to complete payment may result in order cancellation, account restrictions, or suspension of cash on delivery privileges.
7. Refunds, Cancellations, and Disputes
Refunds, cancellations, and dispute resolution are governed by restaurant partner policies and applicable laws. POTOLO may assist in facilitating communication but is not obligated to issue refunds unless required by law or expressly stated.
8. Communications and Messaging (10DLC)
By using the platform, you consent to receive transactional communications such as order confirmations, delivery updates, account alerts, and support messages. Promotional communications are optional and can be opted out at any time. Opting out of promotional messages does not affect transactional communications essential to service delivery.
9. Intellectual Property
All platform content, including software, text, graphics, logos, and designs, is owned by POTOLO or its licensors and protected by intellectual property laws. Unauthorized use, reproduction, or distribution is prohibited.
Users submitting reviews or other content grant POTOLO a worldwide, royalty-free, perpetual license to use, display, and distribute such content in connection with the Service.
10. Privacy and Data Use
User data is collected and processed in accordance with the Potolo Privacy Policy for the Restaurant Platform.
11. Limitation of Liability and Indemnification
POTOLO is not liable for indirect, incidental, consequential, or punitive damages arising from use of the platform, including food quality issues, delivery delays, or restaurant conduct.
You agree to indemnify and hold harmless POTOLO from claims arising out of your use of the Service, violation of these Terms, or content you submit.
12. Suspension and Termination
POTOLO may suspend or terminate accounts at its discretion for violations of these Terms, unlawful conduct, or misuse of the platform. Upon termination, access to your account and associated data may be removed.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United States, State of New Jersey. Any disputes shall be subject to the exclusive jurisdiction of courts located in New Jersey, unless otherwise required by applicable law.
